1. Agreement

These Terms & Conditions ("Terms") govern your use of the TradeScript AI mobile application and related services at tradescript.online (collectively, the "Service") operated by Larinera ("we", "us", or "our").

By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Relationship with Apple

If you obtained the Service through the Apple App Store, you acknowledge that these Terms are between you and Larinera, not Apple.

Apple is not responsible for the Service or its content. Apple has no obligation to furnish maintenance, support, warranty, or product claims services for the Service.

Apple is not responsible for addressing any claims relating to the Service, including product liability claims, failure to conform to legal requirements, or intellectual property infringement claims.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary.

To the extent Apple's standard Licensed Application End User License Agreement (EULA) applies and does not conflict with these Terms, it also governs your use of the App Store-distributed application.

3. Description of the Service

TradeScript AI is a code-generation and educational tool that helps you describe trading strategies in plain language and generate code for supported platforms, including MQL4, MQL5, Pine Script, cTrader cBot, and NinjaScript.

The Service may provide AI-assisted code review, refinement, chat, and related features. The Service does not execute trades, manage brokerage accounts, or provide brokerage services.

4. Not Financial Advice

All content and outputs from the Service are for educational and informational purposes only. Nothing in the Service constitutes financial, investment, trading, legal, or tax advice.

We do not provide trading signals, investment recommendations, or performance guarantees. We do not recommend, endorse, or approve any trading strategy, instrument, or market.

You are solely responsible for evaluating generated code, testing on demo or backtesting environments, and deciding whether to use any strategy in live trading.

Trading involves substantial risk of loss. Past performance, including backtests, does not guarantee future results. You assume full responsibility for any trading losses arising from your use of generated code.

5. AI Limitations

AI-generated and AI-reviewed code may contain errors, omissions, hallucinations, or assumptions that require manual review.

The Service is not a substitute for professional software engineering, security review, or financial advice.

You must independently validate, test, and verify all outputs before deploying them in any environment, especially live trading.

6. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

You are responsible for maintaining the security of your device and for all activity associated with your use of the Service.

7. Subscriptions, Credits, and Billing

Certain features require a paid subscription (TradeScript Pro) or one-time consumable credit pack purchases. All payments are processed by Apple through the App Store.

TradeScript Pro is offered as auto-renewable subscriptions with the following product identifiers: tradescript_pro_monthly (billed monthly) and tradescript_pro_yearly (billed annually). Prices are displayed in the app and App Store at the time of purchase and may vary by region.

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown for the selected plan. You can manage or cancel subscriptions in Settings → Apple ID → Subscriptions on your device.

TradeScript Pro includes 100 credits per billing period. Pro is not unlimited usage. Each successful AI action (such as generate, evaluate, fix, or chat) consumes credits according to the rules shown in the app.

Additional credits may be purchased as consumable packs with product identifiers 100_credits, 500_credits, and 1000_credits. Credit packs are non-transferable, have no cash value, and are consumed when used for eligible AI actions.

Credits remain in your account balance until used or until your account is deleted, unless we change this policy with notice as permitted below.

We use RevenueCat to manage entitlements and purchase status. Billing disputes and refund requests for in-app purchases must be directed to Apple in accordance with Apple's Media Services Terms and conditions.

8. Refunds

We cannot issue refunds for App Store purchases. Refund eligibility is determined by Apple.

9. Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

• Reverse engineering, scraping, or attempting to extract source code or models from the Service.
• Overloading, interfering with, or circumventing rate limits, credit systems, or security measures.
• Using the Service for unlawful purposes or to develop malicious, deceptive, or manipulative trading strategies.
• Submitting content that infringes third-party intellectual property or privacy rights.
• Submitting brokerage credentials, API secrets, or other sensitive authentication data.
• Using automated means to access the Service except as expressly permitted.

We may suspend or terminate access if we reasonably believe you have violated these Terms or applicable law.

10. User Content

You retain ownership of strategy descriptions, prompts, and other inputs you provide.

You grant us a limited, non-exclusive, worldwide license to host, process, transmit, and use your content solely to operate, provide, secure, and improve the Service, including AI processing through our subprocessors.

You represent that you have the rights necessary to submit your content and that your content does not violate law or third-party rights.

11. Intellectual Property

We retain all rights in the Service, including software, branding, documentation, and underlying technology.

Subject to these Terms and applicable third-party platform licenses, you may use generated code for your personal or internal business purposes. You are responsible for compliance with platform terms (such as MetaQuotes, TradingView, cTrader, or NinjaTrader).

12. Third-Party Services and Platforms

The Service may reference or generate code for third-party trading platforms, brokers, or tools. We do not control and are not responsible for their availability, policies, or compatibility.

Your use of third-party platforms is governed by their own terms and licenses.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that generated code is correct, profitable, secure, or suitable for live deployment without your own testing and validation.

14. Limitation of Liability

To the maximum extent permitted by law, Larinera and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or trading losses arising from your use of the Service.

Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us through the App Store in the twelve (12) months before the claim, or (b) fifty US dollars (USD $50).

Nothing in these Terms limits liability that cannot be limited under applicable law. If you are a consumer in the EEA, UK, or Turkey, mandatory statutory rights and remedies apply to the extent required by law.

15. Indemnification

You agree to indemnify and hold harmless Larinera and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your content, your violation of these Terms or law, or your deployment of generated code in live trading or production systems, except to the extent prohibited by applicable consumer protection law.

16. Termination

You may stop using the Service at any time. You may delete your account from Settings → Delete Account in the app.

We may suspend or terminate your access immediately if we reasonably believe you violated these Terms, pose a security risk, or if required by law.

Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will survive.

17. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles.

Subject to mandatory consumer protections, disputes shall be brought before the courts located in the Republic of Turkey.

If you are a consumer in the EEA or UK, you may also benefit from mandatory protections of your country of residence. We encourage you to contact us first at hello@larinera.com to resolve concerns informally.

18. General

Severability: If any provision is held invalid, the remaining provisions remain in effect.

Entire agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Service.

Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

No waiver: Failure to enforce a provision is not a waiver of our right to enforce it later.

19. Changes

We may update these Terms from time to time. Material changes will be reflected on this page with an updated date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires additional consent.
